About this statement
Humbli Pty Ltd is committed to respecting the privacy of your personal and sensitive information. This Privacy Statement explains how we collect, store, use and disclose personal and sensitive information and what steps we take to comply with Privacy Laws.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (CTH) (The Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is personal information?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect may include, but is not limited to:

What is Sensitive information?
Sensitive Information is defined in the Privacy Act to include information or an opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
It is unlikely that we will collect sensitive information, however in the event that we do it will be used by us only:

For the primary purpose for which it was obtained;

For a secondary purpose that is directly related to the primary purpose; and

With your consent; or where required or authorised by Law.
We will only collect sensitive information with your consent, unless there are exceptions which apply under the Privacy Act and APPs. Where you have consented to the collection of sensitive information, you are also taken to have consented to its use and disclosure in accordance with this Privacy Statement.

Why do we collect personal information?
We primarily collect personal information (including sensitive information) to provide our products and services to you, carry out our business activities, comply with laws and regulations and any other purpose that you have consented to or is permitted under the Privacy Act and APPs.

We may also use your personal information (including sensitive information) for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure, such as marketing of new products or services.

We take all reasonable steps to protect your personal information (including sensitive information). Your personal information (including sensitive information) is stored in electronic form in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. We may also store your personal information (including sensitive information) with domestic third-party providers that are also obligated to keep your data confidential. We may also store your personal information (including sensitive information) with overseas third-party providers, however they may be subject to differing privacy laws and regulations (refer below for further information on overseas third party providers).

Access to your personal information
You may access your personal information (including sensitive information) we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your personal information (including sensitive information), please contact us in writing. In order to protect your personal information (including sensitive information), we may require identification from you before releasing the requested information.
Humbli Pty Ltd will not charge any fee for your access request but may charge an administrative fee for providing a copy of your personal information (including sensitive information). Where your request is to update or correct personal information (including sensitive information), we will take reasonable steps to do this in a timely manner.
In certain circumstances we may be unable to give you access to all your personal information (including sensitive information). Some of these circumstances may include:

Where giving you access would compromise some other person’s privacy;

Where giving you access would disclose commercially sensitive and or propriety information of ours, our agents or contractors;

Maintaining the quality of your personal information
It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Exchange of information with overseas parties
To provide our services to you we may exchange your personal information (including sensitive information) with oversees third party service providers, such as (but not limited to) Cloud and other data storage providers. If you provide us with personal information (including sensitive information), you are taken to have consented to the disclosure, transfer, storing or processing of your personal information (including sensitive information) outside of Australia. You acknowledge and agree that by providing your consent:

Humbli Pty Ltd is not required to take reasonable steps to ensure that overseas third parties comply with the Privacy Act and / or APPs;

If the oversees third party provider breaches the Privacy Act and / or APPs in the course of handling your personal information (including sensitive information), Humbli Pty Ltd is not liable under the Privacy Act;

The oversees third party provider may be subject to foreign laws that could compel the disclosure of personal information (including sensitive information) to a third party such as a foreign overseas authority and may not be required to comply with the Privacy Act or APPs;

The oversees third party provider, may not be subject to the same privacy laws and principles in place in Australia; or

You may not be able to seek redress or compensation from the third party oversees provider.

This Privacy Statement sets out our current approach to managing our Privacy obligations. It replaces all previous Humbli Pty Ltd Privacy Statements which have been issued before the date of this Privacy Statement.
